<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id00eb35a3-667c-11e4-89f0-c85f3b491b0a" identifier="/us/usc/t7/s2907"><num value="2907">§ 2907.</num><heading> Refunds</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id00eb35a4-667c-11e4-89f0-c85f3b491b0a" identifier="/us/usc/t7/s2907/a"><num value="a" class="bold">(a)</num><heading class="bold"> Establishment of escrow account</heading><chapeau>During the period prior to the approval of the continuation of an order pursuant to the referendum required under <ref href="/us/usc/t7/s2906/a">section 2906(a) of this title</ref>, subject to subsection (f), the Board shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id00eb35a5-667c-11e4-89f0-c85f3b491b0a" identifier="/us/usc/t7/s2907/a/1"><num value="1">(1)</num><content> establish an escrow account to be used for assessment refunds;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id00eb35a6-667c-11e4-89f0-c85f3b491b0a" identifier="/us/usc/t7/s2907/a/2"><num value="2">(2)</num><content> place funds in such account in accordance with subsection (b); and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id00eb35a7-667c-11e4-89f0-c85f3b491b0a" identifier="/us/usc/t7/s2907/a/3"><num value="3">(3)</num><content> refund assessments to persons in accordance with this section.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id00eb35a8-667c-11e4-89f0-c85f3b491b0a" identifier="/us/usc/t7/s2907/b"><num value="b" class="bold">(b)</num><heading class="bold"> Funding escrow account</heading><chapeau>Subject to subsection (f), the Board shall place in such account, from assessments collected under <ref href="/us/usc/t7/s2906">section 2906 of this title</ref> during the period referred to in subsection (a), an amount equal to the product obtained by multiplying—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id00eb35a9-667c-11e4-89f0-c85f3b491b0a" identifier="/us/usc/t7/s2907/b/1"><num value="1">(1)</num><content> the total amount of assessments collected under <ref href="/us/usc/t7/s2906">section 2906 of this title</ref> during such period; by</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id00eb35aa-667c-11e4-89f0-c85f3b491b0a" identifier="/us/usc/t7/s2907/b/2"><num value="2">(2)</num><chapeau> the greater of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id00eb35ab-667c-11e4-89f0-c85f3b491b0a" identifier="/us/usc/t7/s2907/b/2/A"><num value="A">(A)</num><content> the average rate of assessment refunds provided to producers under State beef promotion, research, and consumer information programs financed through producer assessments, as determined by the Board; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id00eb35ac-667c-11e4-89f0-c85f3b491b0a" identifier="/us/usc/t7/s2907/b/2/B"><num value="B">(B)</num><content> 15 percent.</content>
</subparagraph>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id00eb35ad-667c-11e4-89f0-c85f3b491b0a" identifier="/us/usc/t7/s2907/c"><num value="c" class="bold">(c)</num><heading class="bold"> Demand and receipt of one-time refund</heading><chapeau>Subject to subsections (d), (e), and (f) and notwithstanding any other provision of this chapter,<ref class="footnoteRef" idref="fn002252">1</ref><note type="footnote" id="fn002252"><num>1</num> See References in Text note below.</note> any person shall have the right to demand and receive from the Board a one-time refund of all assessments collected under <ref href="/us/usc/t7/s2906">section 2906 of this title</ref> from such person during the period referred to in subsection (a) if such person—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id00eb35ae-667c-11e4-89f0-c85f3b491b0a" identifier="/us/usc/t7/s2907/c/1"><num value="1">(1)</num><content> is responsible for paying such assessment; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id00eb35af-667c-11e4-89f0-c85f3b491b0a" identifier="/us/usc/t7/s2907/c/2"><num value="2">(2)</num><content> does not support the program established under this chapter.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id00eb35b0-667c-11e4-89f0-c85f3b491b0a" identifier="/us/usc/t7/s2907/d"><num value="d" class="bold">(d)</num><heading class="bold"> Form and time period for demand for one-time refund</heading><content><p style="-uslm-lc:I11" class="indent0">Such demand shall be made in accordance with regulations, on a form, and within a time period prescribed by the Board.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id00eb35b1-667c-11e4-89f0-c85f3b491b0a" identifier="/us/usc/t7/s2907/e"><num value="e" class="bold">(e)</num><heading class="bold"> Submission of proof for one-time refund</heading><chapeau>Such refund shall be made on submission of proof satisfactory to the Board that the producer, person, or importer—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id00eb35b2-667c-11e4-89f0-c85f3b491b0a" identifier="/us/usc/t7/s2907/e/1"><num value="1">(1)</num><content> paid the assessment for which refund is sought; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id00eb35b3-667c-11e4-89f0-c85f3b491b0a" identifier="/us/usc/t7/s2907/e/2"><num value="2">(2)</num><content> did not collect such assessment from another producer, person, or importer.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id00eb35b4-667c-11e4-89f0-c85f3b491b0a" identifier="/us/usc/t7/s2907/f"><num value="f" class="bold">(f)</num><heading class="bold"> Insufficiency of funds in escrow account; pro­ration of funds among eligible persons</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id00eb35b5-667c-11e4-89f0-c85f3b491b0a" identifier="/us/usc/t7/s2907/f/1"><num value="1">(1)</num><chapeau> If the amount in the escrow account required to be established by subsection (a) is not sufficient to refund the total amount of assessments demanded by all eligible persons under this section and the continuation of an order is approved pursuant to the referendum required under section 2906(a) <sup>1</sup> of this title, the Board shall—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id00eb35b6-667c-11e4-89f0-c85f3b491b0a" identifier="/us/usc/t7/s2907/f/1/A"><num value="A">(A)</num><content> continue to place in such account, from assessments collected under <ref href="/us/usc/t7/s2904">section 2904 of this title</ref>, the amount required under subsection (b), until such time as the Board is able to comply with subparagraph (B); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id00eb35b7-667c-11e4-89f0-c85f3b491b0a" identifier="/us/usc/t7/s2907/f/1/B"><num value="B">(B)</num><content> provide to all eligible persons the total amount of assessments demanded by all eligible producers.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id00eb35b8-667c-11e4-89f0-c85f3b491b0a" identifier="/us/usc/t7/s2907/f/2"><num value="2">(2)</num><content> If the amount in the escrow account required to be established by subsection (a) is not sufficient to refund the total amount of assessments demanded by all eligible persons under this section and the continuation of an order is not approved pursuant to the referendum required under <ref href="/us/usc/t7/s2906/a">section 2906(a) of this title</ref>, the Board shall prorate the amount of such refunds among all eligible persons who demand such refund.</content>
