<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id9f9e5df2-0381-11e7-aecc-aa94543f3aa1" identifier="/us/usc/t7/s3175"><num value="3175">§ 3175.</num><heading> Nutrition education program</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id9f9e5df3-0381-11e7-aecc-aa94543f3aa1" identifier="/us/usc/t7/s3175/a"><num value="a" class="bold">(a)</num><heading class="bold"> Definition of 1862 Institution and 1890 Institution</heading><content><p style="-uslm-lc:I11" class="indent0">In this section, the terms “1862 Institution” and “1890 Institution” have the meaning given those terms in <ref href="/us/usc/t7/s7601">section 7601 of this title</ref>.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id9f9e5df4-0381-11e7-aecc-aa94543f3aa1" identifier="/us/usc/t7/s3175/b"><num value="b" class="bold">(b)</num><heading class="bold"> Establishment</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall establish a national education program which shall include, but not be limited to, the dissemination of the results of food and human nutrition research performed or funded by the Department of Agriculture.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id9f9e5df5-0381-11e7-aecc-aa94543f3aa1" identifier="/us/usc/t7/s3175/c"><num value="c" class="bold">(c)</num><heading class="bold"> Employment and training</heading><content><p style="-uslm-lc:I11" class="indent0">To enable low-income individuals and families to engage in nutritionally sound food purchasing and preparation practices, the expanded food and nutrition education program presently conducted under <ref href="/us/usc/t7/s343/d">section 343(d) of this title</ref>, shall provide for the employment and training of professional and paraprofessional aides to engage in direct nutrition education of low-income families and in other appropriate nutrition education programs. To the maximum extent practicable, program aides shall be hired from the indigenous target population.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id9f9e5df6-0381-11e7-aecc-aa94543f3aa1" identifier="/us/usc/t7/s3175/d"><num value="d" class="bold">(d)</num><heading class="bold"> Allocation of funding</heading><chapeau>Beginning with the fiscal year ending <date date="1982-09-30">September 30, 1982</date>—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id9f9e5df7-0381-11e7-aecc-aa94543f3aa1" identifier="/us/usc/t7/s3175/d/1"><num value="1">(1)</num><content> Any funds annually appropriated under <ref href="/us/usc/t7/s343/d">section 343(d) of this title</ref>, for the conduct of the expanded food and nutrition education program, up to the amount appropriated under such section for such program for the fiscal year ending <date date="1981-09-30">September 30, 1981</date>, shall be allocated to each State in the same proportion as funds appropriated under such section for the conduct of the program for the fiscal year ending <date date="1981-09-30">September 30, 1981</date>, are allocated among the States; with the exception that the Secretary may retain up to 2 per centum of such amount for the conduct of such program in States that did not participate in such program in the fiscal year ending <date date="1981-09-30">September 30, 1981</date>.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id9f9e5df8-0381-11e7-aecc-aa94543f3aa1" identifier="/us/usc/t7/s3175/d/2"><num value="2">(2)</num><chapeau> Any funds appropriated annually under <ref href="/us/usc/t7/s343/d">section 343(d) of this title</ref>, for the conduct of the expanded food and nutrition education program in excess of the amount appropriated under such section for the conduct of the program for the fiscal year ending <date date="1981-09-30">September 30, 1981</date>, shall be allocated as follows:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id9f9e5df9-0381-11e7-aecc-aa94543f3aa1" identifier="/us/usc/t7/s3175/d/2/A"><num value="A">(A)</num><content> 4 per centum shall be available to the Secretary for administrative, technical, and other services necessary for the administration of the program.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id9f9e5dfa-0381-11e7-aecc-aa94543f3aa1" identifier="/us/usc/t7/s3175/d/2/B"><num value="B">(B)</num><chapeau> Notwithstanding <ref href="/us/usc/t7/s343/d">section 343(d) of this title</ref>, the remainder shall be allocated among the States as follows:</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id9f9e5dfb-0381-11e7-aecc-aa94543f3aa1" identifier="/us/usc/t7/s3175/d/2/B/i"><num value="i">(i)</num><content> $100,000 shall be distributed to each 1862 Institution and 1890 Institution.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id9f9e5dfc-0381-11e7-aecc-aa94543f3aa1" identifier="/us/usc/t7/s3175/d/2/B/ii"><num value="ii">(ii)</num><chapeau> Subject to clause (iii), the remainder shall be allocated to each State in an amount that bears the same ratio to the total amount to be allocated under this clause as—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id9f9e5dfd-0381-11e7-aecc-aa94543f3aa1" identifier="/us/usc/t7/s3175/d/2/B/ii/I"><num value="I">(I)</num><content> the population living at or below 125 percent of the income poverty guidelines (as prescribed by the Office of Management and Budget and as adjusted pursuant to <ref href="/us/usc/t42/s9902/2">section 9902(2) of title 42</ref>) in the State; bears to</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id9f9e5dfe-0381-11e7-aecc-aa94543f3aa1" identifier="/us/usc/t7/s3175/d/2/B/ii/II"><num value="II">(II)</num><content> the total population living at or below 125 percent of those income poverty guidelines in all States;</content>
</subclause>
</clause>

<continuation style="-uslm-lc:I66" class="indent3 firstIndent-1"> as determined by the most recent decennial census at the time at which each such additional amount is first appropriated.</continuation>
<clause style="-uslm-lc:I14" class="indent3" id="id9f9e5dff-0381-11e7-aecc-aa94543f3aa1" identifier="/us/usc/t7/s3175/d/2/B/iii"><num value="iii">(iii)</num><subclause style="-uslm-lc:I14" class="indent3" id="id9f9e5e00-0381-11e7-aecc-aa94543f3aa1" identifier="/us/usc/t7/s3175/d/2/B/iii/I"><num value="I">(I)</num><chapeau> Before any allocation of funds under clause (ii), for any fiscal year for which the amount of funds appropriated for the conduct of the expanded food and nutrition education program exceeds the amount of funds appropriated for the program for fiscal year 2007, the following percentage of such excess funds for the fiscal year shall be allocated to the 1890 Institutions in accordance with subclause (II):</chapeau><item style="-uslm-lc:I16" class="indent4" id="id9f9e5e01-0381-11e7-aecc-aa94543f3aa1" identifier="/us/usc/t7/s3175/d/2/B/iii/I/aa"><num value="aa">(aa)</num><content> 10 percent for fiscal year 2009.</content>
</item>
<item style="-uslm-lc:I16" class="indent4" id="id9f9e5e02-0381-11e7-aecc-aa94543f3aa1" identifier="/us/usc/t7/s3175/d/2/B/iii/I/bb"><num value="bb">(bb)</num><content> 11 percent for fiscal year 2010.</content>

<item style="-uslm-lc:I16" class="indent4" id="id9f9e5e03-0381-11e7-aecc-aa94543f3aa1" identifier="/us/usc/t7/s3175/d/2/B/iii/I/cc"><num value="cc">(cc)</num><content> 12 percent for fiscal year 2011.</content>

<item style="-uslm-lc:I16" class="indent4" id="id9f9e5e06-0381-11e7-aecc-aa94543f3aa1" identifier="/us/usc/t7/s3175/d/2/B/iii/I/ff"><num value="ff">(ff)</num><content> 15 percent for fiscal year 2014 and for each fiscal year thereafter.</content>

<subclause style="-uslm-lc:I14" class="indent3" id="id9f9e5e07-0381-11e7-aecc-aa94543f3aa1" identifier="/us/usc/t7/s3175/d/2/B/iii/II"><num value="II">(II)</num><chapeau> Funds made available under subclause (I) shall be allocated to each 1890 Institution in an amount that bears the same ratio to the total amount to be allocated under this clause as—</chapeau><item style="-uslm-lc:I16" class="indent4" id="id9f9e5e08-0381-11e7-aecc-aa94543f3aa1" identifier="/us/usc/t7/s3175/d/2/B/iii/II/aa"><num value="aa">(aa)</num><content> the population living at or below 125 percent of the income poverty guidelines (as prescribed by the Office of Management and Budget and as adjusted pursuant to <ref href="/us/usc/t42/s9902/2">section 9902(2) of title 42</ref>) in the State in which the 1890 Institution is located; bears to</content>

<item style="-uslm-lc:I16" class="indent4" id="id9f9e5e09-0381-11e7-aecc-aa94543f3aa1" identifier="/us/usc/t7/s3175/d/2/B/iii/II/bb"><num value="bb">(bb)</num><content> the total population living at or below 125 percent of those income poverty guidelines in all States in which 1890 Institutions are located;</content>

<continuation style="-uslm-lc:I66" class="indent3 firstIndent-1"> as determined by the most recent decennial census at the time at which each such additional amount is first appropriated.</continuation>
<clause style="-uslm-lc:I14" class="indent3" id="id9f9e5e0a-0381-11e7-aecc-aa94543f3aa1" identifier="/us/usc/t7/s3175/d/2/B/iv"><num value="iv">(iv)</num><content> Nothing in this subparagraph precludes the Secretary from developing educational materials and programs for persons in income ranges above the level designated in this subparagraph.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id9f9e5e0b-0381-11e7-aecc-aa94543f3aa1" identifier="/us/usc/t7/s3175/e"><num value="e" class="bold">(e)</num><heading class="bold"> Complementary administration</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall ensure the complementary administration of the expanded food and nutrition education program by 1862 Institutions and 1890 Institutions in a State.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id9f9e5e0c-0381-11e7-aecc-aa94543f3aa1" identifier="/us/usc/t7/s3175/f"><num value="f" class="bold">(f)</num><heading class="bold"> Authorization of appropriations</heading><content><p style="-uslm-lc:I11" class="indent0">There is authorized to be appropriated to carry out the expanded food and nutrition education program established under <ref href="/us/usc/t7/s343/d">section 343(d) of this title</ref> and this section $90,000,000 for each of fiscal years 2009 through 2018.</p>
