<p style="-uslm-lc:I11" class="indent0">The Secretary of Agriculture may conduct a program of wildlife services with respect to injurious animal species and take any action the Secretary considers necessary in conducting the program. The Secretary shall administer the program in a manner consistent with all of the wildlife services authorities in effect on the day before <date date="2000-10-28">October 28, 2000</date>.</p>

<section style="-uslm-lc:I580467"><num value="6202">“SEC. 6202.</num><heading> WOLF COMPENSATION AND PREVENTION PROGRAM.</heading><subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><chapeau>The Secretaries shall establish a 5-year demonstration program to provide grants to States and Indian tribes—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> to assist livestock producers in undertaking proactive, non-lethal activities to reduce the risk of livestock loss due to predation by wolves; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> to compensate livestock producers for livestock losses due to such predation.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Criteria and Requirements</inline>.—</heading><chapeau>The Secretaries shall—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> establish criteria and requirements to implement the program; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><chapeau> when promulgating regulations to implement the program under paragraph (1), consult with States that have implemented State programs that provide assistance to—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> livestock producers to undertake proactive activities to reduce the risk of livestock loss due to predation by wolves; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> provide compensation to livestock producers for livestock losses due to such predation.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Eligibility</inline>.—</heading><chapeau>To be eligible to receive a grant under subsection (a), a State or Indian tribe shall—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> designate an appropriate agency of the State or Indian tribe to administer the 1 or more programs funded by the grant;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> establish 1 or more accounts to receive grant funds;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> maintain files of all claims received under programs funded by the grant, including supporting documentation;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><chapeau> submit to the Secretary—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><chapeau> annual reports that include—</chapeau><clause style="-uslm-lc:I24" class="indent3"><num value="i">“(i)</num><content> a summary of claims and expenditures under the program during the year; and</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ii">“(ii)</num><content> a description of any action taken on the claims; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> such other reports as the Secretary may require to assist the Secretary in determining the effectiveness of activities provided assistance under this section; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><content> promulgate rules for reimbursing livestock producers under the program.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Allocation of Funding</inline>.—</heading><chapeau>The Secretaries shall allocate funding made available to carry out this subtitle—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> equally between the uses identified in paragraphs (1) and (2) of subsection (a); and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><chapeau> among States and Indian tribes based on—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> the level of livestock predation in the State or on the land owned by, or held in trust for the benefit of, the Indian tribe;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> whether the State or Indian tribe is located in a geographical area that is at high risk for livestock predation; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> any other factors that the Secretaries determine are appropriate.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="e">“(e)</num><heading> <inline class="small-caps">Eligible Land</inline>.—</heading><content>Activities and losses described in subsection (a) may occur on Federal, State, or private land, or land owned by, or held in trust for the benefit of, an Indian tribe.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="f">“(f)</num><heading> <inline class="small-caps">Federal Cost Share</inline>.—</heading><content>The Federal share of the cost of any activity provided assistance made available under this subtitle shall not exceed 50 percent of the total cost of the activity.</content>

<section style="-uslm-lc:I580467"><num value="6203">“SEC. 6203.</num><heading> AUTHORIZATION OF APPROPRIATIONS.</heading><content><p style="-uslm-lc:I21" class="indent0">“There is authorized to be appropriated to carry out this subtitle $1,000,000 for fiscal year 2009 and each fiscal year thereafter.”</p>
