<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id6b163843-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101"><num value="5101">§ 5101.</num><heading> Qualifying States</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6b163844-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I11" class="indent0">A State is a qualifying State if the Secretary of Agriculture (hereinafter in this chapter referred to as the “Secretary”) determines that the State has in effect a mediation program that meets the requirements of subsection (c).</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6b163845-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/b"><num value="b" class="bold">(b)</num><heading class="bold"> Determination by Secretary</heading><content><p style="-uslm-lc:I11" class="indent0">Within 15 days after the Secretary receives from the Governor of a State a description of the mediation program of the State and a statement certifying that the State has met all of the requirements of subsection (c), the Secretary shall determine whether the State is a qualifying State.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6b163846-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/c"><num value="c" class="bold">(c)</num><heading class="bold"> Requirements of State mediation programs</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6b163847-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Issues covered</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6b163848-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/c/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">To be certified as a qualifying State, the mediation program of the State must provide mediation services to persons described in paragraph (2) that are involved in agricultural loans (regardless of whether the loans are made or guaranteed by the Secretary or made by a third party).</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6b163849-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/c/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Other issues</heading><chapeau>The mediation program of a qualifying State may provide mediation services to persons described in paragraph (2) that are involved in one or more of the following issues under the jurisdiction of the Department of Agriculture:</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id6b16384a-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/c/1/B/i"><num value="i">(i)</num><content> Wetlands determinations.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id6b16384b-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/c/1/B/ii"><num value="ii">(ii)</num><content> Compliance with farm programs, including conservation programs.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id6b16384c-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/c/1/B/iii"><num value="iii">(iii)</num><content> Agricultural credit.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id6b16384d-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/c/1/B/iv"><num value="iv">(iv)</num><content> Rural water loan programs.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id6b16384e-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/c/1/B/v"><num value="v">(v)</num><content> Grazing on National Forest System land.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id6b16384f-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/c/1/B/vi"><num value="vi">(vi)</num><content> Pesticides.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id6b163850-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/c/1/B/vii"><num value="vii">(vii)</num><content> Such other issues as the Secretary considers appropriate.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6b163851-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Persons eligible for mediation</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6b163852-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/c/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau>Subject to subparagraph (B), the persons referred to in paragraph (1) include—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id6b163853-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/c/2/A/i"><num value="i">(i)</num><content> agricultural producers;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id6b163854-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/c/2/A/ii"><num value="ii">(ii)</num><content> creditors of producers (as applicable); and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id6b163855-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/c/2/A/iii"><num value="iii">(iii)</num><content> persons directly affected by actions of the Department of Agriculture.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6b163856-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/c/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Voluntary participation</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id6b163857-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/c/2/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I14" class="indent3">Subject to clause (ii) and <ref href="/us/usc/t7/s5103">section 5103 of this title</ref>, a person may not be compelled to participate in mediation services provided under this Act.</p>

<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id6b163858-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/c/2/B/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> State laws</heading><content><p style="-uslm-lc:I14" class="indent3">Clause (i) shall not affect a State law requiring mediation before foreclosure on agricultural land or property.</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6b163859-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Certification conditions</heading><chapeau>The Secretary shall certify a State as a qualifying State with respect to the issues proposed to be covered by the mediation program of the State if the mediation program—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6b16385a-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/c/3/A"><num value="A">(A)</num><content> provides for mediation services that, if decisions are reached, result in mediated, mutually agreeable decisions between the parties to the mediation;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6b16385b-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/c/3/B"><num value="B">(B)</num><content> is authorized or administered by an agency of the State government or by the Governor of the State;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6b16385c-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/c/3/C"><num value="C">(C)</num><content> provides for the training of mediators;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6b16385d-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/c/3/D"><num value="D">(D)</num><content> provides that the mediation sessions shall be confidential;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6b16385e-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/c/3/E"><num value="E">(E)</num><content> ensures, in the case of agricultural loans, that all lenders and borrowers of agricultural loans receive adequate notification of the mediation program; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6b16385f-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/c/3/F"><num value="F">(F)</num><content> ensures, in the case of other issues covered by the mediation program, that persons directly affected by actions of the Department of Agriculture receive adequate notification of the mediation program.</content>
</subparagraph>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6b163860-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/d"><num value="d" class="bold">(d)</num><heading class="bold"> Definition of mediation services</heading><chapeau>In this section, the term “mediation services”, with respect to mediation or a request for mediation, may include all activities related to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6b163861-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/d/1"><num value="1">(1)</num><content> the intake and scheduling of cases;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6b163862-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/d/2"><num value="2">(2)</num><content> the provision of background and selected information regarding the mediation process;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6b163863-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/d/3"><num value="3">(3)</num><content> financial advisory and counseling services (as appropriate) performed by a person other than a State mediation program mediator; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6b163864-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s5101/d/4"><num value="4">(4)</num><content> the mediation session.</content>
