<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id6b2e0747-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s6509"><num value="6509">§ 6509.</num><heading> Animal production practices and materials</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6b2e0748-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s6509/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I11" class="indent0">Any livestock that is to be slaughtered and sold or labeled as organically produced shall be raised in accordance with this chapter.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6b2e0749-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s6509/b"><num value="b" class="bold">(b)</num><heading class="bold"> Breeder stock</heading><content><p style="-uslm-lc:I11" class="indent0">Breeder stock may be purchased from any source if such stock is not in the last third of gestation.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6b2e074a-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s6509/c"><num value="c" class="bold">(c)</num><heading class="bold"> Practices</heading><chapeau>For a farm to be certified under this chapter as an organic farm with respect to the livestock produced by such farm, producers on such farm—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6b2e074b-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s6509/c/1"><num value="1">(1)</num><content> shall feed such livestock organically produced feed that meets the requirements of this chapter;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6b2e074c-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s6509/c/2"><num value="2">(2)</num><chapeau> shall not use the following feed—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6b2e074d-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s6509/c/2/A"><num value="A">(A)</num><content> plastic pellets for roughage;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6b2e074e-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s6509/c/2/B"><num value="B">(B)</num><content> manure refeeding; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6b2e074f-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s6509/c/2/C"><num value="C">(C)</num><content> feed formulas containing urea; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6b2e0750-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s6509/c/3"><num value="3">(3)</num><content> shall not use growth promoters and hormones on such livestock, whether implanted, ingested, or injected, including antibiotics and synthetic trace elements used to stimulate growth or production of such livestock.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6b2e0751-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s6509/d"><num value="d" class="bold">(d)</num><heading class="bold"> Health care</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6b2e0752-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s6509/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Prohibited practices</heading><chapeau>For a farm to be certified under this chapter as an organic farm with respect to the livestock produced by such farm, producers on such farm shall not—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6b2e0753-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s6509/d/1/A"><num value="A">(A)</num><content> use subtherapeutic doses of antibiotics;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6b2e0754-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s6509/d/1/B"><num value="B">(B)</num><content> use synthetic internal parasiticides on a routine basis; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6b2e0755-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s6509/d/1/C"><num value="C">(C)</num><content> administer medication, other than vaccinations, in the absence of illness.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6b2e0756-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s6509/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Standards</heading><content><p style="-uslm-lc:I12" class="indent1">The National Organic Standards Board shall recommend to the Secretary standards in addition to those in paragraph (1) for the care of livestock to ensure that such livestock is organically produced.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6b2e0757-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s6509/e"><num value="e" class="bold">(e)</num><heading class="bold"> Additional guidelines</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6b2e0758-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s6509/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> Poultry</heading><content><p style="-uslm-lc:I12" class="indent1">With the exception of day old poultry, all poultry from which meat or eggs will be sold or labeled as organically produced shall be raised and handled in accordance with this chapter prior to and during the period in which such meat or eggs are sold.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6b2e0759-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s6509/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Dairy livestock</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6b2e075a-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s6509/e/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Except as provided in subparagraph (B), a dairy animal from which milk or milk products will be sold or labeled as organically produced shall be raised and handled in accordance with this chapter for not less than the 12-month period immediately prior to the sale of such milk and milk products.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6b2e075b-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s6509/e/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Transition guideline</heading><content><p style="-uslm-lc:I13" class="indent2">Crops and forage from land included in the organic system plan of a dairy farm that is in the third year of organic management may be consumed by the dairy animals of the farm during the 12-month period immediately prior to the sale of organic milk and milk products.</p>

</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6b2e075c-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s6509/f"><num value="f" class="bold">(f)</num><heading class="bold"> Livestock identification</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6b2e075d-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s6509/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">For a farm to be certified under this chapter as an organic farm with respect to the livestock produced by such farm, producers on such farm shall keep adequate records and maintain a detailed, verifiable audit trail so that each animal (or in the case of poultry, each flock) can be traced back to such farm.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6b2e075e-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s6509/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Records</heading><chapeau>In order to carry out paragraph (1), each producer shall keep accurate records on each animal (or in the case of poultry, each flock) including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6b2e075f-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s6509/f/2/A"><num value="A">(A)</num><content> amounts and sources of all medications administered; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6b2e0760-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s6509/f/2/B"><num value="B">(B)</num><content> all feeds and feed supplements bought and fed.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6b2e0761-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s6509/g"><num value="g" class="bold">(g)</num><heading class="bold"> Notice and public comment</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall hold public hearings and shall develop detailed regulations, with notice and public comment, to guide the implementation of the standards for livestock products provided under this section.</p>
