<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ideb8f9eff-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232"><num value="7232">§ 7232.</num><heading> Loan rates for marketing assistance loans</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ideb8f9f00-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/a"><num value="a" class="bold">(a)</num><heading class="bold"> Wheat</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ideb8f9f01-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Loan rate</heading><chapeau style="-uslm-lc:I12" class="indent1">Subject to paragraph (2), the loan rate for a marketing assistance loan under <ref href="/us/usc/t7/s7231">section 7231 of this title</ref> for wheat shall be—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ideb8f9f02-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/a/1/A"><num value="A">(A)</num><content> not less than 85 percent of the simple average price received by producers of wheat, as determined by the Secretary, during the marketing years for the immediately preceding 5 crops of wheat, excluding the year in which the average price was the highest and the year in which the average price was the lowest in the period; but</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ideb8f9f03-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/a/1/B"><num value="B">(B)</num><content> not more than $2.58 per bushel.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ideb8f9f04-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Stocks to use ratio adjustment</heading><chapeau style="-uslm-lc:I12" class="indent1">If the Secretary estimates for any marketing year that the ratio of ending stocks of wheat to total use for the marketing year will be—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ideb8f9f05-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/a/2/A"><num value="A">(A)</num><content> equal to or greater than 30 percent, the Secretary may reduce the loan rate for wheat for the corresponding crop by an amount not to exceed 10 percent in any year;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ideb8f9f06-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/a/2/B"><num value="B">(B)</num><content> less than 30 percent but not less than 15 percent, the Secretary may reduce the loan rate for wheat for the corresponding crop by an amount not to exceed 5 percent in any year; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ideb8f9f07-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/a/2/C"><num value="C">(C)</num><content> less than 15 percent, the Secretary may not reduce the loan rate for wheat for the corresponding crop.</content>
</subparagraph>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ideb8f9f08-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/b"><num value="b" class="bold">(b)</num><heading class="bold"> Feed grains</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ideb8f9f09-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Loan rate for corn</heading><chapeau style="-uslm-lc:I12" class="indent1">Subject to paragraph (2), the loan rate for a marketing assistance loan under <ref href="/us/usc/t7/s7231">section 7231 of this title</ref> for corn shall be—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ideb8f9f0a-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/b/1/A"><num value="A">(A)</num><content> not less than 85 percent of the simple average price received by producers of corn, as determined by the Secretary, during the marketing years for the immediately preceding 5 crops of corn, excluding the year in which the average price was the highest and the year in which the average price was the lowest in the period; but</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ideb8fc51b-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/b/1/B"><num value="B">(B)</num><content> not more than $1.89 per bushel.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ideb8fc51c-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Stocks to use ratio adjustment</heading><chapeau style="-uslm-lc:I12" class="indent1">If the Secretary estimates for any marketing year that the ratio of ending stocks of corn to total use for the marketing year will be—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ideb8fc51d-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/b/2/A"><num value="A">(A)</num><content> equal to or greater than 25 percent, the Secretary may reduce the loan rate for corn for the corresponding crop by an amount not to exceed 10 percent in any year;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ideb8fc51e-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/b/2/B"><num value="B">(B)</num><content> less than 25 percent but not less than 12.5 percent, the Secretary may reduce the loan rate for corn for the corresponding crop by an amount not to exceed 5 percent in any year; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ideb8fc51f-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/b/2/C"><num value="C">(C)</num><content> less than 12.5 percent, the Secretary may not reduce the loan rate for corn for the corresponding crop.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ideb8fc520-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Other feed grains</heading><content><p style="-uslm-lc:I12" class="indent1">The loan rate for a marketing assistance loan under <ref href="/us/usc/t7/s7231">section 7231 of this title</ref> for grain sorghum, barley, and oats, respectively, shall be established at such level as the Secretary determines is fair and reasonable in relation to the rate that loans are made available for corn, taking into consideration the feeding value of the commodity in relation to corn.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ideb8fc521-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/c"><num value="c" class="bold">(c)</num><heading class="bold"> Upland cotton</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ideb8fc522-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Loan rate</heading><chapeau style="-uslm-lc:I12" class="indent1">Subject to paragraph (2), the loan rate for a marketing assistance loan under <ref href="/us/usc/t7/s7231">section 7231 of this title</ref> for upland cotton shall be established by the Secretary at such loan rate, per pound, as will reflect for the base quality of upland cotton, as determined by the Secretary, at average locations in the United States a rate that is not less than the smaller of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ideb8fc523-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/c/1/A"><num value="A">(A)</num><content> 85 percent of the average price (weighted by market and month) of the base quality of cotton as quoted in the designated United States spot markets during 3 years of the 5-year period ending July 31 of the year preceding the year in which the crop is planted, excluding the year in which the average price was the highest and the year in which the average price was the lowest in the period; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ideb8fc524-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/c/1/B"><num value="B">(B)</num><content> 90 percent of the average, for the 15-week period beginning July 1 of the year preceding the year in which the crop is planted, of the 5 lowest-priced growths of the growths quoted for Middling 1<sup>3</sup>⁄<sub>32</sub>-inch cotton C.I.F. Northern Europe (adjusted downward by the average difference during the period April 15 through October 15 of the year preceding the year in which the crop is planted between the average Northern European price quotation of such quality of cotton and the market quotations in the designated United States spot markets for the base quality of upland cotton), as determined by the Secretary.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ideb8fc525-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Limitations</heading><content><p style="-uslm-lc:I12" class="indent1">The loan rate for a marketing assistance loan for upland cotton shall not be less than $0.50 per pound or more than $0.5192 per pound.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ideb8fc526-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/d"><num value="d" class="bold">(d)</num><heading class="bold"> Extra long staple cotton</heading><chapeau style="-uslm-lc:I11" class="indent0">The loan rate for a marketing assistance loan under <ref href="/us/usc/t7/s7231">section 7231 of this title</ref> for extra long staple cotton shall be—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ideb8fc527-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/d/1"><num value="1">(1)</num><content> not less than 85 percent of the simple average price received by producers of extra long staple cotton, as determined by the Secretary, during 3 years of the 5-year period ending July 31 of the year preceding the year in which the crop is planted, excluding the year in which the average price was the highest and the year in which the average price was the lowest in the period; but</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ideb8fc528-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/d/2"><num value="2">(2)</num><content> not more than $0.7965 per pound.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ideb8fc529-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/e"><num value="e" class="bold">(e)</num><heading class="bold"> Rice</heading><content><p style="-uslm-lc:I11" class="indent0">The loan rate for a marketing assistance loan under <ref href="/us/usc/t7/s7231">section 7231 of this title</ref> for rice shall be $6.50 per hundredweight.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ideb8fc52a-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/f"><num value="f" class="bold">(f)</num><heading class="bold"> Oilseeds</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ideb8fc52b-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> Soybeans</heading><chapeau style="-uslm-lc:I12" class="indent1">The loan rate for a marketing assistance loan under <ref href="/us/usc/t7/s7231">section 7231 of this title</ref> for soybeans shall be—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ideb8fc52c-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/f/1/A"><num value="A">(A)</num><content> not less than 85 percent of the simple average price received by producers of soybeans, as determined by the Secretary, during the marketing years for the immediately preceding 5 crops of soybeans, excluding the year in which the average price was the highest and the year in which the average price was the lowest in the period; but</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ideb8fc52d-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/f/1/B"><num value="B">(B)</num><content> not less than $4.92 or more than $5.26 per bushel.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ideb8fc52e-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Sunflower seed, canola, rapeseed, safflower, mustard seed, and flaxseed</heading><chapeau style="-uslm-lc:I12" class="indent1">The loan rate for a marketing assistance loan under <ref href="/us/usc/t7/s7231">section 7231 of this title</ref> for sunflower seed, canola, rapeseed, safflower, mustard seed, and flaxseed, individually, shall be—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ideb8fec3f-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/f/2/A"><num value="A">(A)</num><content> not less than 85 percent of the simple average price received by producers of sunflower seed, individually, as determined by the Secretary, during the marketing years for the immediately preceding 5 crops of sunflower seed, individually, excluding the year in which the average price was the highest and the year in which the average price was the lowest in the period; but</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ideb8fec40-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/f/2/B"><num value="B">(B)</num><content> not less than $0.087 or more than $0.093 per pound.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ideb8fec41-099f-11eb-b61c-e565d2c02f40" identifier="/us/usc/t7/s7232/f/3"><num value="3" class="bold">(3)</num><heading class="bold"> Other oilseeds</heading><content><p style="-uslm-lc:I12" class="indent1">The loan rates for a marketing assistance loan under <ref href="/us/usc/t7/s7231">section 7231 of this title</ref> for other oilseeds shall be established at such level as the Secretary determines is fair and reasonable in relation to the loan rate available for soybeans, except in no event shall the rate for the oilseeds (other than cottonseed) be less than the rate established for soybeans on a per-pound basis for the same crop.</p>
