<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id089da270-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7486"><num value="7486">§ 7486.</num><heading> Petition and review</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id089da271-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7486/a"><num value="a" class="bold">(a)</num><heading class="bold"> Petition</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id089da272-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7486/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau>A person subject to an order may file with the Secretary a petition—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id089da273-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7486/a/1/A"><num value="A">(A)</num><content> stating that the order, a provision of the order, or an obligation imposed in connection with the order is not established in accordance with law; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id089da274-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7486/a/1/B"><num value="B">(B)</num><content> requesting a modification of the order or obligation or an exemption from the order or obligation.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id089da275-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7486/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Statute of limitations</heading><content><p style="-uslm-lc:I12" class="indent1">A petition under paragraph (1) concerning an obligation may be filed not later than 2 years after the date of imposition of the obligation.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id089da276-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7486/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Hearings</heading><content><p style="-uslm-lc:I12" class="indent1">The petitioner shall be given the opportunity for a hearing on a petition filed under paragraph (1), in accordance with regulations issued by the Secretary.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id089da277-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7486/a/4"><num value="4" class="bold">(4)</num><heading class="bold"> Ruling</heading><content><p style="-uslm-lc:I12" class="indent1">After a hearing under paragraph (3), the Secretary shall issue a ruling on the petition that is the subject of the hearing, which shall be final if the ruling is in accordance with applicable law.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id089da278-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7486/b"><num value="b" class="bold">(b)</num><heading class="bold"> Review</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id089da279-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7486/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Commencement of action</heading><content><p style="-uslm-lc:I12" class="indent1">The district court of the United States for any district in which a person who is a petitioner under subsection (a) resides or carries on business shall have jurisdiction to review a ruling on the petition, if the person files a complaint not later than 20 days after the date of issuance of the ruling under subsection (a)(4).</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id089da27a-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7486/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Process</heading><content><p style="-uslm-lc:I12" class="indent1">Service of process in a proceeding under paragraph (1) may be made on the Secretary by delivering a copy of the complaint to the Secretary.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id089da27b-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7486/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Remands</heading><chapeau>If the court determines, under paragraph (1), that a ruling issued under subsection (a)(4) is not in accordance with applicable law, the court shall remand the matter to the Secretary with directions—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id089dc98c-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7486/b/3/A"><num value="A">(A)</num><content> to make such ruling as the court shall determine to be in accordance with law; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id089dc98d-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7486/b/3/B"><num value="B">(B)</num><content> to take such further proceedings as, in the opinion of the court, the law requires.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id089dc98e-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7486/c"><num value="c" class="bold">(c)</num><heading class="bold"> Enforcement</heading><content><p style="-uslm-lc:I11" class="indent0">The pendency of proceedings instituted under subsection (a) may not impede, hinder, or delay the Secretary or the Attorney General from taking action under <ref href="/us/usc/t7/s7487">section 7487 of this title</ref>.</p>
