L. 106–224, title IV, § 402, June 20, 2000, 114 Stat. 438.)","seq_in_title":2626,"parent_identifier":"/us/usc/t7/ch104","ancestors":[{"identifier":"/us/usc/t7","level":"title","num":"Title 7—","heading":"AGRICULTURE","status":null,"is_section":false},{"identifier":"/us/usc/t7/ch104","level":"chapter","num":"CHAPTER 104—","heading":"PLANT PROTECTION","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id4a27994c-22ee-11e8-bdf4-b68a334b17a8\" identifier=\"/us/usc/t7/s7701\"><num value=\"7701\">§ 7701.</num><heading> Findings</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Congress finds that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4a27994d-22ee-11e8-bdf4-b68a334b17a8\" identifier=\"/us/usc/t7/s7701/1\"><num value=\"1\">(1)</num><content> the detection, control, eradication, suppression, prevention, or retardation of the spread of plant pests or noxious weeds is necessary for the protection of the agriculture, environment, and economy of the United States;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4a27994e-22ee-11e8-bdf4-b68a334b17a8\" identifier=\"/us/usc/t7/s7701/2\"><num value=\"2\">(2)</num><content> biological control is often a desirable, low-risk means of ridding crops and other plants of plant pests and noxious weeds, and its use should be facilitated by the Department of Agriculture, other Federal agencies, and States whenever feasible;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4a27994f-22ee-11e8-bdf4-b68a334b17a8\" identifier=\"/us/usc/t7/s7701/3\"><num value=\"3\">(3)</num><content> it is the responsibility of the Secretary to facilitate exports, imports, and interstate commerce in agricultural products and other commodities that pose a risk of harboring plant pests or noxious weeds in ways that will reduce, to the extent practicable, as determined by the Secretary, the risk of dissemination of plant pests or noxious weeds;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4a279950-22ee-11e8-bdf4-b68a334b17a8\" identifier=\"/us/usc/t7/s7701/4\"><num value=\"4\">(4)</num><content> decisions affecting imports, exports, and interstate movement of products regulated under this chapter shall be based on sound science;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4a279951-22ee-11e8-bdf4-b68a334b17a8\" identifier=\"/us/usc/t7/s7701/5\"><num value=\"5\">(5)</num><content> the smooth movement of enterable plants, plant products, biological control organisms, or other articles into, out of, or within the United States is vital to the United State’s <ref class=\"footnoteRef\" idref=\"fn002328\">1</ref><note type=\"footnote\" id=\"fn002328\"><num>1</num> So in original.</note> economy and should be facilitated to the extent possible;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4a279952-22ee-11e8-bdf4-b68a334b17a8\" identifier=\"/us/usc/t7/s7701/6\"><num value=\"6\">(6)</num><content> export markets could be severely impacted by the introduction or spread of plant pests or noxious weeds into or within the United States;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4a279953-22ee-11e8-bdf4-b68a334b17a8\" identifier=\"/us/usc/t7/s7701/7\"><num value=\"7\">(7)</num><content> the unregulated movement of plant pests, noxious weeds, plants, certain biological control organisms, plant products, and articles capable of harboring plant pests or noxious weeds could present an unacceptable risk of introducing or spreading plant pests or noxious weeds;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4a27c064-22ee-11e8-bdf4-b68a334b17a8\" identifier=\"/us/usc/t7/s7701/8\"><num value=\"8\">(8)</num><content> the existence on any premises in the United States of a plant pest or noxious weed new to or not known to be widely prevalent in or distributed within and throughout the United States could constitute a threat to crops and other plants or plant products of the United States and burden interstate commerce or foreign commerce; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4a27c065-22ee-11e8-bdf4-b68a334b17a8\" identifier=\"/us/usc/t7/s7701/9\"><num value=\"9\">(9)</num><content> all plant pests, noxious weeds, plants, plant products, articles capable of harboring plant pests or noxious weeds regulated under this chapter are in or affect interstate commerce or foreign commerce.</content>\n</paragraph>\n<sourceCredit id=\"id4a27c066-22ee-11e8-bdf4-b68a334b17a8\">(<ref href=\"/us/pl/106/224/tIV\">Pub. L. 110–234, title X</ref>, § 10204, <date date=\"2008-05-22\">May 22, 2008</date>, <ref href=\"/us/stat/122/1343\">122 Stat. 1343</ref>, and <ref href=\"/us/pl/110/246\">Pub. and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> as the Secretary considers appropriate, promulgate regulations to improve the management and oversight of articles regulated under the Plant Protection Act (<ref href=\"/us/usc/t7/s7701\">7 U.S.C. 7701</ref> et seq.).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Inclusions</inline>.—</heading><chapeau>In carrying out subsection (a), the Secretary shall take actions that are designed to enhance—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> the quality and completeness of records;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> the availability of representative samples;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> the maintenance of identity and control in the event of an unauthorized release;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><content> corrective actions in the event of an unauthorized release;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><content> protocols for conducting molecular forensics;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"6\">“(6)</num><content> clarity in contractual agreements;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"7\">“(7)</num><content> the use of the latest scientific techniques for isolation and confinement distances;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"8\">“(8)</num><content> standards for quality management systems and effective research; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"9\">“(9)</num><content> the design of electronic permits to store documents and other information relating to the permit and notification processes.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Consideration</inline>.—</heading><chapeau>In carrying out subsection (a), the Secretary shall consider—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><chapeau> establishing—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> a system of risk-based categories to classify each regulated article;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> a means to identify regulated articles (including the retention of seed samples); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><content> standards for isolation and containment distances; and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><chapeau> requiring permit holders—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> to maintain a positive chain of custody;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> to provide for the maintenance of records;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><content> to provide for the accounting of material;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"D\">“(D)</num><content> to conduct periodic audits;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"E\">“(E)</num><content> to establish an appropriate training program;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"F\">“(F)</num><content> to provide contingency and corrective action plans; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"G\">“(G)</num><content> to submit reports as the Secretary considers to be appropriate.”</content>\n</subparagraph>\n</paragraph>\n</subsection>\n</quotedContent>\n</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">[<ref href=\"/us/pl/110/234\">Pub.
