<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id08ab0fd5-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783"><num value="7783">§ 7783.</num><heading> Grants to weed management entities</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id08ab0fd6-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/a"><num value="a" class="bold">(a)</num><heading class="bold"> Consultation and consent</heading><chapeau>In carrying out a grant under this subchapter, the weed management entity and the Secretary shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id08ab0fd7-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/a/1"><num value="1">(1)</num><content> if the activities funded under the grant will take place on Federal land, consult with the heads of the Federal agencies having jurisdiction over the land; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id08ab0fd8-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/a/2"><num value="2">(2)</num><content> obtain the written consent of the non-Federal landowner.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id08ab0fd9-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/b"><num value="b" class="bold">(b)</num><heading class="bold"> Grant considerations</heading><chapeau>In determining the amount of a grant to a weed management entity, the Secretary shall consider—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id08ab0fda-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/b/1"><num value="1">(1)</num><content> the severity or potential severity of the noxious weed problem;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id08ab0fdb-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/b/2"><num value="2">(2)</num><content> the extent to which the Federal funds will be used to leverage non-Federal funds to address the noxious weed problem;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id08ab0fdc-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/b/3"><num value="3">(3)</num><content> the extent to which the weed management entity has made progress in addressing the noxious weeds problem; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id08ab0fdd-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/b/4"><num value="4">(4)</num><content> other factors that the Secretary determines to be relevant.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id08ab0fde-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/c"><num value="c" class="bold">(c)</num><heading class="bold"> Use of grant funds; cost shares</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id08ab0fdf-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Use of grants</heading><content><p style="-uslm-lc:I12" class="indent1">A weed management entity that receives a grant under subsection (a) shall use the grant funds to carry out a project authorized by subsection (d) for the control or eradication of a noxious weed.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id08ab0fe0-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Cost shares</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id08ab0fe1-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/c/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Federal cost share</heading><content><p style="-uslm-lc:I13" class="indent2">The Federal share of the cost of carrying out an authorized project under this section exclusively on non-Federal land shall not exceed 50 percent.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id08ab0fe2-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/c/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Form of non-Federal cost share</heading><content><p style="-uslm-lc:I13" class="indent2">The non-Federal share of the cost of carrying out an authorized project under this section may be provided in cash or in kind.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id08ab36f3-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/d"><num value="d" class="bold">(d)</num><heading class="bold"> Authorized projects</heading><chapeau>Projects funded by grants under this section include the following:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id08ab36f4-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/d/1"><num value="1">(1)</num><content> Education, inventories and mapping, management, monitoring, methods development, and other capacity building activities, including the payment of the cost of personnel and equipment that promote control or eradication of noxious weeds.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id08ab36f5-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/d/2"><num value="2">(2)</num><content> Other activities to control or eradicate noxious weeds or promote control or eradication of noxious weeds.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id08ab36f6-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/e"><num value="e" class="bold">(e)</num><heading class="bold"> Application</heading><content><p style="-uslm-lc:I11" class="indent0">To be eligible to receive assistance under this section, a weed management entity shall prepare and submit to the Secretary an application containing such information as the Secretary shall by regulation require.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id08ab36f7-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/f"><num value="f" class="bold">(f)</num><heading class="bold"> Selection of projects</heading><chapeau>Projects funded under this section shall be selected by the Secretary on a competitive basis, taking into consideration the following:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id08ab36f8-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/f/1"><num value="1">(1)</num><content> The severity of the noxious weed problem or potential problem addressed by the project.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id08ab36f9-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/f/2"><num value="2">(2)</num><content> The likelihood that the project will prevent or resolve the problem, or increase knowledge about resolving similar problems.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id08ab36fa-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/f/3"><num value="3">(3)</num><content> The extent to which the Federal funds will leverage non-Federal funds to address the noxious weed problem addressed by the project.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id08ab36fb-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/f/4"><num value="4">(4)</num><content> The extent to which the program will improve the overall capacity of the United States to address noxious weed control and management.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id08ab36fc-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/f/5"><num value="5">(5)</num><content> The extent to which the weed management entity has made progress in addressing noxious weed problems.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id08ab36fd-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/f/6"><num value="6">(6)</num><content> The extent to which the project will provide a comprehensive approach to the control or eradication of noxious weeds.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id08ab36fe-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/f/7"><num value="7">(7)</num><content> The extent to which the project will reduce the total population of noxious weeds.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id08ab36ff-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/f/8"><num value="8">(8)</num><content> The extent to which the project promotes cooperation and participation between States that have common interests in controlling and eradicating noxious weeds.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id08ab3700-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/f/9"><num value="9">(9)</num><content> Other factors that the Secretary determines to be relevant.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id08ab3701-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/g"><num value="g" class="bold">(g)</num><heading class="bold"> Regional, State, and local involvement</heading><chapeau>In determining which projects receive funding under this section, the Secretary shall, to the maximum extent practicable—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id08ab3702-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/g/1"><num value="1">(1)</num><content> rely on technical and merit reviews provided by regional, State, or local weed management experts; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id08ab3703-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/g/2"><num value="2">(2)</num><content> give priority to projects that maximize the involvement of State, local and, where applicable, Indian Tribe governments.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id08ab3704-8c63-11e9-b85c-f2648b4e4a41" identifier="/us/usc/t7/s7783/h"><num value="h" class="bold">(h)</num><heading class="bold"> Special consideration</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall give special consideration to States with approved weed management entities established by Indian Tribes and may provide an additional allocation to a State to meet the particular needs and projects that the weed management entity plans to address.</p>
