<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id6b5da1c0-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s7971"><num value="7971">§ 7971.</num><heading> Storage facility loans</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6b5da1c1-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s7971/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I11" class="indent0">Notwithstanding any other provision of law and as soon as practicable after <date date="2002-05-13">May 13, 2002</date>, the Commodity Credit Corporation shall amend part 1436 of title 7, Code of Federal Regulations, to establish a sugar storage facility loan program to provide financing for processors of domestically-produced sugarcane and sugar beets to construct or upgrade storage and handling facilities for raw sugars and refined sugars.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6b5da1c2-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s7971/b"><num value="b" class="bold">(b)</num><heading class="bold"> Eligible processors</heading><chapeau>A storage facility loan described in subsection (a) shall be made available to any processor of domestically produced sugarcane or sugar beets that (as determined by the Secretary)—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6b5da1c3-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s7971/b/1"><num value="1">(1)</num><content> has a satisfactory credit history;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6b5da1c4-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s7971/b/2"><num value="2">(2)</num><content> has a need for increased storage capacity, taking into account the effects of marketing allotments; and</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id6b5da1c5-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s7971/b/3"><num value="3">(3)</num><content> demonstrates an ability to repay the loan.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6b5da1c6-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s7971/c"><num value="c" class="bold">(c)</num><heading class="bold"> Term of loans</heading><chapeau>A storage facility loan described in subsection (a) shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6b5da1c7-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s7971/c/1"><num value="1">(1)</num><content> have a minimum term of 7 years;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6b5da1c8-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s7971/c/2"><num value="2">(2)</num><content> not include any penalty for prepayment; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6b5da1c9-ec38-11e5-ab42-dae4a1e80e35" identifier="/us/usc/t7/s7971/c/3"><num value="3">(3)</num><content> be in such amounts and on such other terms and conditions (including terms and conditions relating to downpayments, collateral, and eligible facilities) as are normal, customary, and appropriate for the size and commercial nature of the borrower.</content>
