value=\"8103\">§ 8103.</num><heading> Biorefinery, renewable chemical, and biobased product manufacturing assistance</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id57e89f94-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Purpose</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The purpose of this section is to assist in the development of new and emerging technologies for the development of advanced biofuels, renewable chemicals, and biobased product manufacturing so as to—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id57e89f95-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/a/1\"><num value=\"1\">(1)</num><content> increase the energy independence of the United States;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id57e89f96-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/a/2\"><num value=\"2\">(2)</num><content> promote resource conservation, public health, and the environment;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id57e89f97-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/a/3\"><num value=\"3\">(3)</num><content> diversify markets for agricultural and forestry products and agriculture waste material; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id57e89f98-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/a/4\"><num value=\"4\">(4)</num><content> create jobs and enhance the economic development of the rural economy.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id57e89f99-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Definitions</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In this section:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id57e89f9a-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Biobased product manufacturing</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “biobased product manufacturing” means development, construction, and retrofitting of technologically new commercial-scale processing and manufacturing equipment and required facilities that will be used to convert renewable chemicals and other biobased outputs of biorefineries into end-user products on a commercial scale.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id57e89f9b-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Eligible entity</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “eligible entity” means an individual, entity, Indian tribe, or unit of State or local government, including a corporation, farm cooperative, farmer cooperative organization, association of agricultural producers, National Laboratory, institution of higher education, rural electric cooperative, public power entity, or consortium of any of those entities.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id57e89f9c-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Eligible technology</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “eligible technology” means, as determined by the Secretary—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id57e89f9d-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/b/3/A\"><num value=\"A\">(A)</num><chapeau> a technology that is being adopted in a viable commercial-scale operation of a biorefinery that produces any 1 or more, or a combination, of—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id57e89f9e-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/b/3/A/i\"><num value=\"i\">(i)</num><content> an advanced biofuel;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id57e89f9f-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/b/3/A/ii\"><num value=\"ii\">(ii)</num><content> a renewable chemical; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id57e89fa0-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/b/3/A/iii\"><num value=\"iii\">(iii)</num><content> a biobased product; and</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id57e89fa1-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/b/3/B\"><num value=\"B\">(B)</num><chapeau> a technology not described in subparagraph (A) that has been demonstrated to have technical and economic potential for commercial application in a biorefinery that produces any 1 or more, or a combination, of—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id57e89fa2-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/b/3/B/i\"><num value=\"i\">(i)</num><content> an advanced biofuel;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id57e89fa3-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/b/3/B/ii\"><num value=\"ii\">(ii)</num><content> a renewable chemical; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id57e89fa4-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/b/3/B/iii\"><num value=\"iii\">(iii)</num><content> a biobased product.</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id57e89fa5-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Assistance</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall make available to eligible entities guarantees for loans made to fund the development, construction, and retrofitting of commercial-scale biorefineries using eligible technology.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id57e89fa6-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Loan guarantees</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id57e89fa7-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Selection criteria</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id57e89fa8-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/d/1/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">In approving loan guarantee applications, the Secretary shall establish a priority scoring system that assigns priority scores to each application and only approve applications that exceed a specified minimum, as determined by the Secretary.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id57e89fa9-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/d/1/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Feasibility</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">In approving a loan guarantee application, the Secretary shall determine the technical and economic feasibility of the project based on a feasibility study of the project described in the application conducted by an independent third party.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id57e89faa-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/d/1/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Scoring system</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">In determining the priority scoring system for loan guarantees under subsection (c), the Secretary shall consider—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id57e89fab-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/d/1/C/i\"><num value=\"i\">(i)</num><content> whether the applicant has established a market for the advanced biofuel and the byproducts produced;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id57e89fac-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/d/1/C/ii\"><num value=\"ii\">(ii)</num><content> whether the area in which the applicant proposes to place the biorefinery has other similar facilities;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id57e89fad-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/d/1/C/iii\"><num value=\"iii\">(iii)</num><content> whether the applicant is proposing to use a feedstock not previously used in the production of advanced biofuels;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id57e89fae-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/d/1/C/iv\"><num value=\"iv\">(iv)</num><content> whether the applicant is proposing to work with producer associations or cooperatives;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id57e89faf-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/d/1/C/v\"><num value=\"v\">(v)</num><content> the level of financial participation by the applicant, including support from non-Federal and private sources;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id57e89fb0-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/d/1/C/vi\"><num value=\"vi\">(vi)</num><content> whether the applicant has established that the adoption of the process proposed in the application will have a positive impact on resource conservation, public health, and the environment;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id57e89fb1-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/d/1/C/vii\"><num value=\"vii\">(vii)</num><content> whether the applicant can establish that if adopted, the biofuels production technology proposed in the application will not have any significant negative impacts on existing manufacturing plants or other facilities that use similar feedstocks;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id57e89fb2-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/d/1/C/viii\"><num value=\"viii\">(viii)</num><content> the potential for rural economic development;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id57e89fb3-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/d/1/C/ix\"><num value=\"ix\">(ix)</num><content> the level of local ownership proposed in the application; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id57e89fb4-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/d/1/C/x\"><num value=\"x\">(x)</num><content> whether the project can be replicated.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id57e89fb5-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/d/1/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Project diversity</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">In approving loan guarantee applications, the Secretary shall ensure that, to the extent practicable, there is diversity in the types of projects approved for loan guarantees to ensure that as wide a range as possible of technologies, products, and approaches are assisted.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id57e89fb6-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Limitations</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id57e89fb7-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/d/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Maximum amount of loan guaranteed</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The principal amount of a loan guaranteed under subsection (c) may not exceed $250,000,000.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id57e89fb8-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/d/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Maximum percentage of loan guaranteed</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id57e89fb9-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/d/2/B/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">Except as otherwise provided in this subparagraph, a loan guaranteed under subsection (c) shall be in an amount not to exceed 80 percent of the project costs, as determined by the Secretary.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id57e89fba-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/d/2/B/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Other direct Federal funding</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The amount of a loan guaranteed for a project under subsection (c) shall be reduced by the amount of other direct Federal funding that the eligible entity receives for the same project.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id57e89fbb-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/d/2/B/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Authority to guarantee the loan</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The Secretary may guarantee up to 90 percent of the principal and interest due on a loan guaranteed under subsection (c).</p>\n</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id57e89fbc-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/d/2/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Loan guarantee fund distribution</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Of the funds made available for loan guarantees for a fiscal year under subsection (g), 50 percent of the funds shall be reserved for obligation during the second half of the fiscal year.</p>\n</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id57e89fbd-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Consultation</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In carrying out this section, the Secretary shall consult with the Secretary of Energy.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id57e89fbe-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Condition on provision of assistance</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id57e89fbf-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/f/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">As a condition of receiving a grant or loan guarantee under this section, an eligible entity shall ensure that all laborers and mechanics employed by contractors or subcontractors in the performance of construction work financed, in whole or in part, with the grant or loan guarantee, as the case may be, shall be paid wages at rates not less than those prevailing on similar construction in the locality, as determined by the Secretary of Labor in accordance with sections 3141 through 3144, 3146, and 3147 of title 40.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id57e89fc0-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/f/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Authority and functions</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary of Labor shall have, with respect to the labor standards described in paragraph (1), the authority and functions set forth in Reorganization Plan Numbered 14 of 1950 (5 U.S.C. App) and <ref href=\"/us/usc/t40/s3145\">section 3145 of title 40</ref>.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id57e89fc1-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Funding</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id57e89fc2-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/g/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Mandatory funding</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id57e89fc3-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/g/1/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Subject to subparagraph (B), of the funds of the Commodity Credit Corporation, the Secretary shall use for the cost of loan guarantees under this section, to remain available until expended—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id57e89fc4-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/g/1/A/i\"><num value=\"i\">(i)</num><content> $100,000,000 for fiscal year 2014;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id57e89fc5-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/g/1/A/ii\"><num value=\"ii\">(ii)</num><content> $50,000,000 for each of fiscal years 2015 and 2016;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id57e89fc6-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/g/1/A/iii\"><num value=\"iii\">(iii)</num><content> $50,000,000 for fiscal year 2019; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id57e89fc7-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/g/1/A/iv\"><num value=\"iv\">(iv)</num><content> $25,000,000 for fiscal year 2020.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id57e89fc8-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/g/1/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Biobased product manufacturing</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Of the total amount of funds made available for fiscal years 2014 and 2015 under subparagraph (A), the Secretary may use for the cost of loan guarantees under this section not more than 15 percent of such funds to promote biobased product manufacturing.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id57e89fc9-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/g/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Discretionary funding</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">In addition to any other funds made available to carry out this section, there is authorized to be appropriated to carry out this section $75,000,000 for each of fiscal years 2014 through 2023.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id57e89fca-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/h\"><num value=\"h\" class=\"bold\">(h)</num><heading class=\"bold\"> Additional funding for electric loans for renewable energy</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id57e89fcb-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/h/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Appropriations</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Notwithstanding subsections (a) through (e), and (g), in addition to amounts otherwise available, there is appropriated to the Secretary for fiscal year 2022, out of any money in the Treasury not otherwise appropriated, $1,000,000,000, to remain available until <date date=\"2031-09-30\">September 30, 2031</date>, for the cost of loans under <ref href=\"/us/usc/t7/s940g\">section 940g of title 7</ref>, including for projects that store electricity that support the types of eligible projects under that section, which shall be forgiven in an amount that is not greater than 50 percent of the loan based on how the borrower and the project meets the terms and conditions for loan forgiveness consistent with the purposes of that section established by the Secretary, except as provided in paragraph (3).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id57e89fcc-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/h/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Limitation</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall not enter into any loan agreement pursuant this subsection that could result in disbursements after <date date=\"2031-09-30\">September 30, 2031</date>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id57e89fcd-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/h/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Exception</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall establish criteria for waiving the 50 percent limitation described in paragraph (1).</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id57e89fce-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Biofuel infrastructure and agriculture product market expansion</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id57e89fcf-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/i/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Appropriation</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Notwithstanding subsections (a) through (e) and subsection (g), in addition to amounts otherwise available, there is appropriated to the Secretary for fiscal year 2022, out of any money in the Treasury not otherwise appropriated, $500,000,000, to remain available until <date date=\"2031-09-30\">September 30, 2031</date>, to carry out this subsection.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id57e89fd0-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/i/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Use of funds</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall use the amounts made available by paragraph (1) to provide grants, for which the Federal share shall be not more than 75 percent of the total cost of carrying out a project for which the grant is provided, on a competitive basis, to increase the sale and use of agricultural commodity-based fuels through infrastructure improvements for blending, storing, supplying, or distributing biofuels, except for transportation infrastructure not on location where such biofuels are blended, stored, supplied, or distributed—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id57e89fd1-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/i/2/A\"><num value=\"A\">(A)</num><content> by installing, retrofitting, or otherwise upgrading fuel dispensers or pumps and related equipment, storage tank system components, and other infrastructure required at a location related to dispensing certain biofuel blends to ensure the increased sales of fuels with high levels of commodity-based ethanol and biodiesel that are at or greater than the levels required in the Notice of Funding Availability for the Higher Blends Infrastructure Incentive Program for Fiscal Year 2020, published in the Federal Register (85 Fed. Reg. 26656), as determined by the Secretary; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id57e89fd2-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/i/2/B\"><num value=\"B\">(B)</num><content> by building and retrofitting home heating oil distribution centers or equivalent entities and distribution systems for ethanol and biodiesel blends.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id57e89fd3-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/j\"><num value=\"j\" class=\"bold\">(j)</num><heading class=\"bold\"> USDA assistance for rural electric cooperatives</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id57e89fd4-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/j/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Appropriation</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Notwithstanding subsections (a) through (e) and (g), in addition to amounts otherwise available, there is appropriated to the Secretary for fiscal year 2022, out of any money in the Treasury not otherwise appropriated, $9,700,000,000, to remain available until <date date=\"2031-09-30\">September 30, 2031</date>, for the long-term resiliency, reliability, and affordability of rural electric systems by providing to an eligible entity (defined as an electric cooperative described in section 501(c)(12) or 1381(a)(2) of title 26 and is or has been a Rural Utilities Service electric loan borrower pursuant to the Rural Electrification Act of 1936 [<ref href=\"/us/usc/t7/s901\">7 U.S.C. 901</ref> et seq.] or serving a predominantly rural area or a wholly or jointly owned subsidiary of such electric cooperative) loans, modifications of loans, the cost of loans and modifications, and other financial assistance to achieve the greatest reduction in carbon dioxide, methane, and nitrous oxide emissions associated with rural electric systems through the purchase of renewable energy, renewable energy systems, zero-emission systems, and carbon capture and storage systems, to deploy such systems, or to make energy efficiency improvements to electric generation and transmission systems of the eligible entity after <date date=\"2022-08-16\">August 16, 2022</date>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id57e89fd5-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/j/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Limitation</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">No eligible entity may receive an amount equal to more than 10 percent of the total amount made available by this subsection.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id57e89fd6-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/j/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Requirement</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The amount of a grant under this subsection shall be not more than 25 percent of the total project costs of the eligible entity carrying out a project using a grant under this subsection.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id57e89fd7-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/j/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Prohibition</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Nothing in this subsection shall be interpreted to authorize funds of the Commodity Credit Corporation for activities under this subsection if such funds are not expressly authorized or currently expended for such purposes.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id57e89fd8-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/j/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Disbursements</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall not enter into, pursuant to this subsection—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id57e89fd9-0605-11ee-8439-d88a3b42634b\" identifier=\"/us/usc/t7/s8103/j/5/A\"><num value=\"A\">(A)</num><content> any loan agreement that may result in a disbursement after <date date=\"2031-09-30\">September 30, 2031</date>;
