<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id53b27208-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113"><num value="8113">§ 8113.</num><heading> Community wood energy program</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id53b27209-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/a"><num value="a" class="bold">(a)</num><heading class="bold"> Definitions</heading><chapeau>In this section:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id53b2720a-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Biomass consumer cooperative</heading><content><p style="-uslm-lc:I12" class="indent1">The term “biomass consumer cooperative” means a consumer membership organization the purpose of which is to provide members with services or discounts relating to the purchase of biomass heating products or biomass heating systems.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id53b2720b-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Community wood energy plan</heading><chapeau>The term “community wood energy plan” means an assessment of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id53b2720c-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/a/2/A"><num value="A">(A)</num><content> available feedstocks necessary to supply a community wood energy system; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id53b2720d-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/a/2/B"><num value="B">(B)</num><content> the long-term feasibility of supplying and operating a community wood energy system.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id53b2720e-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Community wood energy system</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id53b2720f-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/a/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau>The term “community wood energy system” means an energy system that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id53b27210-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/a/3/A/i"><num value="i">(i)</num><content> primarily services public facilities owned or operated by State or local governments, including schools, town halls, libraries, and other public buildings; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id53b27211-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/a/3/A/ii"><num value="ii">(ii)</num><content> uses woody biomass as the primary fuel.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id53b27212-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/a/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Inclusions</heading><content><p style="-uslm-lc:I13" class="indent2">The term “community wood energy system” includes single facility central heating, district heating, combined heat and energy systems, and other related biomass energy systems.</p>

</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id53b27213-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/b"><num value="b" class="bold">(b)</num><heading class="bold"> Grant program</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id53b27214-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau>The Secretary, acting through the Chief of the Forest Service, shall establish a program to be known as the “Community Wood Energy Program” to provide—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id53b27215-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/b/1/A"><num value="A">(A)</num><content> grants of up to $50,000 to State and local governments (or designees) to develop community wood energy plans;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id53b27216-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/b/1/B"><num value="B">(B)</num><content> competitive grants to State and local governments to acquire or upgrade community wood energy systems; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id53b27217-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/b/1/C"><num value="C">(C)</num><chapeau> grants of up to $50,000 to biomass consumer cooperatives for the purpose of establishing or expanding biomass consumer cooperatives that will provide consumers with services or discounts relating to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id53b27218-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/b/1/C/i"><num value="i">(i)</num><content> the purchase of biomass heating systems;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id53b27219-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/b/1/C/ii"><num value="ii">(ii)</num><content> biomass heating products, including wood chips, wood pellets, and advanced biofuels; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id53b2721a-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/b/1/C/iii"><num value="iii">(iii)</num><content> the delivery and storage of biomass of heating products.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id53b2721b-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Considerations</heading><chapeau>In selecting applicants for grants under paragraph (1)(B), the Secretary shall consider—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id53b2721c-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/b/2/A"><num value="A">(A)</num><content> the energy efficiency of the proposed system;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id53b2721d-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/b/2/B"><num value="B">(B)</num><content> the cost effectiveness of the proposed system; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id53b2721e-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/b/2/C"><num value="C">(C)</num><content> other conservation and environmental criteria that the Secretary considers appropriate.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id53b2721f-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Use of plan</heading><content><p style="-uslm-lc:I12" class="indent1">A State or local government applying to receive a competitive grant described in paragraph (1)(B) shall submit to the Secretary as part of the grant application the applicable community wood energy plan.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id53b27220-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/c"><num value="c" class="bold">(c)</num><heading class="bold"> Limitation</heading><chapeau>A community wood energy system acquired with grant funds provided under subsection (b)(1)(B) shall not exceed an output of—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id53b27221-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/c/1"><num value="1">(1)</num><content> 50,000,000 Btu per hour for heating; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id53b27222-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/c/2"><num value="2">(2)</num><content> 2 megawatts for electric power production.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id53b27223-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/d"><num value="d" class="bold">(d)</num><heading class="bold"> Matching funds</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id53b27224-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> State and local governments</heading><content><p style="-uslm-lc:I12" class="indent1">A State or local government that receives a grant under subparagraph (A) or (B) of subsection (b)(1) shall contribute an amount of non-Federal funds towards the development of the community wood energy plan, or acquisition of the community wood energy systems that is at least equal to the amount of grant funds received by the State or local government under that subsection.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id53b27225-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Biomass consumer cooperatives</heading><content><p style="-uslm-lc:I12" class="indent1">A biomass consumer cooperative that receives a grant under subsection (b)(1)(C) shall contribute an amount of non-Federal funds (which may include State, local, and nonprofit funds and membership dues) toward the establishment or expansion of a biomass consumer cooperative that is at least equal to 50 percent of the amount of Federal funds received for that purpose.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id53b27226-bf32-11e3-b5d9-a54f02b4e3bf" identifier="/us/usc/t7/s8113/e"><num value="e" class="bold">(e)</num><heading class="bold"> Authorization of appropriations</heading><content><p style="-uslm-lc:I11" class="indent0">There is authorized to be appropriated to carry out this section $5,000,000 for each of fiscal years 2009 through 2018.</p>
