<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id3640498a-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s8304"><num value="8304">§ 8304.</num><heading> Exportation</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id3640498b-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s8304/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary may prohibit or restrict—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id3640498c-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s8304/a/1"><num value="1">(1)</num><content> the exportation of any animal, article, or means of conveyance if the Secretary determines that the prohibition or restriction is necessary to prevent the dissemination from or within the United States of any pest or disease of livestock;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3640498d-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s8304/a/2"><num value="2">(2)</num><content> the exportation of any livestock if the Secretary determines that the livestock is unfit to be moved;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3640498e-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s8304/a/3"><num value="3">(3)</num><content> the use of any means of conveyance or facility in connection with the exportation of any animal or article if the Secretary determines that the prohibition or restriction is necessary to prevent the dissemination from or within the United States of any pest or disease of livestock; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3640498f-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s8304/a/4"><num value="4">(4)</num><content> the use of any means of conveyance in connection with the exportation of livestock if the Secretary determines that the prohibition or restriction is necessary because the means of conveyance has not been maintained in a clean and sanitary condition or does not have accommodations for the safe and proper movement and humane treatment of livestock.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id36404990-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s8304/b"><num value="b" class="bold">(b)</num><heading class="bold"> Requirements of owners</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id36404991-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s8304/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Orders to disinfect</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary may require the disinfection of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id36404992-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s8304/b/1/A"><num value="A">(A)</num><content> a means of conveyance used in connection with the exportation of an animal;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id36404993-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s8304/b/1/B"><num value="B">(B)</num><content> an individual involved in the exportation of an animal and personal articles of the individual; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id36404994-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s8304/b/1/C"><num value="C">(C)</num><content> any article used in the exportation of an animal.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id36404995-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s8304/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Failure to comply with orders</heading><chapeau style="-uslm-lc:I12" class="indent1">If an owner fails to comply with an order of the Secretary under this section, the Secretary may—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id36404996-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s8304/b/2/A"><num value="A">(A)</num><content> take remedial action with respect to the animal, article, or means of conveyance referred to in paragraph (1); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id36404997-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s8304/b/2/B"><num value="B">(B)</num><content> recover from the owner the costs of any care, handling, disposal, or other action incurred by the Secretary in connection with the remedial action.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id36404998-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s8304/c"><num value="c" class="bold">(c)</num><heading class="bold"> Certification</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary may certify the classification, quality, quantity, condition, processing, handling, or storage of any animal or article intended for export.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id36404999-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s8304/d"><num value="d" class="bold">(d)</num><heading class="bold"> Authorization of appropriations</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id3640499a-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s8304/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">There is authorized to be appropriated—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3640499b-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s8304/d/1/A"><num value="A">(A)</num><content> $1,500,000 for each of fiscal years 2008 through 2018 to carry out section 11010 of the Food, Conservation, and Energy Act of 2008; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3640499c-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s8304/d/1/B"><num value="B">(B)</num><content> such sums as may be necessary for each of fiscal years 2008 through 2018 to carry out this section.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id3640499d-7fa0-11ec-94a7-ad9af92efa12" identifier="/us/usc/t7/s8304/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Availability</heading><content><p style="-uslm-lc:I12" class="indent1">Funds appropriated under paragraph (1) shall remain available until expended.</p>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">Report</inline>.—</heading><chapeau>If final regulations are not published in accordance with paragraph (2) within 90 days of the date of the enactment of this Act, the Secretary shall submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report containing—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> an explanation of why the final regulations have not been issued in accordance with paragraph (2); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> the date on which the Secretary expects to issue such final regulations.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Funding</inline>.—</heading><content>Subject to the availability of appropriations under subsection (d)(1)(A) of section 10405 of the Animal Health Protection Act (<ref href="/us/usc/t7/s8304">7 U.S.C. 8304</ref>), as added by subsection (c), the Secretary shall use not less than $6,200,000 of the funds made available under such subsection to carry out subsection (a).”</content>
