L. 107–171, title X, § 10408, May 13, 2002, 116 Stat. 500.)","seq_in_title":2795,"parent_identifier":"/us/usc/t7/ch109","ancestors":[{"identifier":"/us/usc/t7","level":"title","num":"Title 7—","heading":"AGRICULTURE","status":null,"is_section":false},{"identifier":"/us/usc/t7/ch109","level":"chapter","num":"CHAPTER 109—","heading":"ANIMAL HEALTH PROTECTION","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id3642b9df-7fa0-11ec-94a7-ad9af92efa12\" identifier=\"/us/usc/t7/s8307\"><num value=\"8307\">§ 8307.</num><heading> Inspections, seizures, and warrants</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id3642b9e0-7fa0-11ec-94a7-ad9af92efa12\" identifier=\"/us/usc/t7/s8307/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Guidelines</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The activities authorized by this section shall be carried out consistent with guidelines approved by the Attorney General.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id3642b9e1-7fa0-11ec-94a7-ad9af92efa12\" identifier=\"/us/usc/t7/s8307/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Warrantless inspections</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary may stop and inspect, without a warrant, any person or means of conveyance moving—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id3642b9e2-7fa0-11ec-94a7-ad9af92efa12\" identifier=\"/us/usc/t7/s8307/b/1\"><num value=\"1\">(1)</num><content> into the United States, to determine whether the person or means of conveyance is carrying any animal or article regulated under this chapter;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id3642b9e3-7fa0-11ec-94a7-ad9af92efa12\" identifier=\"/us/usc/t7/s8307/b/2\"><num value=\"2\">(2)</num><content> in interstate commerce, on probable cause to believe that the person or means of conveyance is carrying any animal or article regulated under this chapter; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id3642b9e4-7fa0-11ec-94a7-ad9af92efa12\" identifier=\"/us/usc/t7/s8307/b/3\"><num value=\"3\">(3)</num><content> in intrastate commerce from any State, or any portion of a State, quarantined under <ref href=\"/us/usc/t7/s8306/b\">section 8306(b) of this title</ref>, on probable cause to believe that the person or means of conveyance is carrying any animal or article quarantined under <ref href=\"/us/usc/t7/s8306/b\">section 8306(b) of this title</ref>.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id3642b9e5-7fa0-11ec-94a7-ad9af92efa12\" identifier=\"/us/usc/t7/s8307/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Inspections with warrants</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id3642b9e6-7fa0-11ec-94a7-ad9af92efa12\" identifier=\"/us/usc/t7/s8307/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary may enter, with a warrant, any premises in the United States for the purpose of making inspections and seizures under this chapter.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id3642b9e7-7fa0-11ec-94a7-ad9af92efa12\" identifier=\"/us/usc/t7/s8307/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Application and issuance of warrants</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id3642b9e8-7fa0-11ec-94a7-ad9af92efa12\" identifier=\"/us/usc/t7/s8307/c/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">On proper oath or affirmation showing probable cause to believe that there is on certain premises any animal, article, facility, or means of conveyance regulated under this chapter, a United States judge, a judge of a court of record in the United States, or a United States magistrate judge may issue a warrant for the entry on premises within the jurisdiction of the judge or magistrate to make any inspection or seizure under this chapter.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id3642b9e9-7fa0-11ec-94a7-ad9af92efa12\" identifier=\"/us/usc/t7/s8307/c/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Execution</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The warrant may be applied for and executed by the Secretary or any United States marshal.</p>\n</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id3642b9ea-7fa0-11ec-94a7-ad9af92efa12\">(<ref href=\"/us/pl/107/171/tX/s10408\">Pub.
