<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idf10c820d-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a"><num value="8308a">§ 8308a.</num><heading> Animal disease prevention and management</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idf10c820e-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/a"><num value="a" class="bold">(a)</num><heading class="bold"> National Animal Health Laboratory Network</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf10c820f-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Definition of eligible laboratory</heading><content><p style="-uslm-lc:I12" class="indent1">In this subsection, the term “eligible laboratory” means a diagnostic laboratory that meets specific criteria developed by the Secretary, in consultation with State animal health officials, State veterinary diagnostic laboratories, and veterinary diagnostic laboratories at institutions of higher education (as defined in <ref href="/us/usc/t20/s1001">section 1001 of title 20</ref>).</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf10c8210-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary, in consultation with State veterinarians, shall offer to enter into contracts, grants, cooperative agreements, or other legal instruments with eligible laboratories for any of the following purposes:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf10c8211-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/a/2/A"><num value="A">(A)</num><content> To enhance the capability of the Secretary to respond in a timely manner to emerging or existing bioterrorist threats to animal health.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf10c8212-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/a/2/B"><num value="B">(B)</num><chapeau> To provide the capacity and capability for standardized—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idf10c8213-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/a/2/B/i"><num value="i">(i)</num><content> test procedures, reference materials, and equipment;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf10c8214-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/a/2/B/ii"><num value="ii">(ii)</num><content> laboratory biosafety and biosecurity levels;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf10c8215-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/a/2/B/iii"><num value="iii">(iii)</num><content> quality management system requirements;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf10c8216-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/a/2/B/iv"><num value="iv">(iv)</num><content> interconnected electronic reporting and transmission of data; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf10c8217-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/a/2/B/v"><num value="v">(v)</num><content> evaluation for emergency preparedness.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf10c8218-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/a/2/C"><num value="C">(C)</num><content> To coordinate the development, implementation, and enhancement of national veterinary diagnostic laboratory capabilities, with special emphasis on surveillance planning and vulnerability analysis, technology development and validation, training, and outreach.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf10c8219-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Priority</heading><content><p style="-uslm-lc:I12" class="indent1">To the extent practicable and to the extent capacity and specialized expertise may be necessary, the Secretary shall give priority to existing Federal facilities, State facilities, and facilities at institutions of higher education.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idf10c821a-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b"><num value="b" class="bold">(b)</num><heading class="bold"> National Animal Disease Preparedness and Response Program</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf10c821b-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Program required</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall establish a program, to be known as the National Animal Disease Preparedness and Response Program (referred to in this section as “the Program”), to address the increasing risk of the introduction and spread within the United States of animal pests and diseases affecting the economic interests of the livestock and related industries of the United States, including the maintenance and expansion of export markets.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf10c821c-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Program activities</heading><chapeau style="-uslm-lc:I12" class="indent1">Activities under the Program shall include, to the extent practicable, the following:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf10c821d-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/2/A"><num value="A">(A)</num><content> Enhancing animal pest and disease analysis and surveillance.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf10c821e-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/2/B"><num value="B">(B)</num><content> Expanding outreach and education.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf10c821f-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/2/C"><num value="C">(C)</num><content> Targeting domestic inspection activities at vulnerable points in the safeguarding continuum.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf10c8220-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/2/D"><num value="D">(D)</num><content> Enhancing and strengthening threat identification technology.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf10c8221-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/2/E"><num value="E">(E)</num><content> Improving biosecurity.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf10c8222-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/2/F"><num value="F">(F)</num><content> Enhancing emergency preparedness and response capabilities, including training additional emergency response personnel.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf10c8223-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/2/G"><num value="G">(G)</num><content> Conducting technology development to enhance electronic sharing of animal health data for risk analysis between State and Federal animal health officials.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf10c8224-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/2/H"><num value="H">(H)</num><chapeau> Enhancing the development and effectiveness of animal health technologies to treat and prevent animal disease, including—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idf10c8225-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/2/H/i"><num value="i">(i)</num><content> veterinary biologics and diagnostics;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf10c8226-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/2/H/ii"><num value="ii">(ii)</num><content> animal drugs for minor uses and minor species;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf10c8227-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/2/H/iii"><num value="iii">(iii)</num><content> animal medical devices; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf10c8228-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/2/H/iv"><num value="iv">(iv)</num><content> emerging veterinary countermeasures.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf10c8229-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/2/I"><num value="I">(I)</num><content> Such other activities as determined appropriate by the Secretary, in consultation with eligible entities specified in paragraph (3).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf10c822a-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Eligible entities</heading><chapeau style="-uslm-lc:I12" class="indent1">To carry out the Program, the Secretary shall offer to enter into cooperative agreements or other legal instruments, as authorized under <ref href="/us/usc/t7/s8312">section 8312 of this title</ref> (referred to in this section as “agreements”) with eligible entities, to be selected by the Secretary, which may include any of the following entities, either individually or in combination:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf10c822b-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/3/A"><num value="A">(A)</num><content> A State department of agriculture.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf10c822c-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/3/B"><num value="B">(B)</num><content> The office of the chief animal health official of a State.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf10c822d-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/3/C"><num value="C">(C)</num><content> An entity eligible to receive funds under a capacity and infrastructure program (as defined in <ref href="/us/usc/t7/s6971/f/1/C">section 6971(f)(1)(C) of this title</ref>).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf10c822e-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/3/D"><num value="D">(D)</num><content> A college of veterinary medicine, including a veterinary emergency team at such college.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf10c822f-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/3/E"><num value="E">(E)</num><content> A State or national livestock producer organization with direct and significant economic interest in livestock production.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf10c8230-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/3/F"><num value="F">(F)</num><content> A State emergency agency.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf10c8231-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/3/G"><num value="G">(G)</num><content> A State, national, allied, or regional veterinary organization or specialty board recognized by the American Veterinary Medical Association.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf10c8232-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/3/H"><num value="H">(H)</num><content> An Indian Tribe.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf10c8233-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/3/I"><num value="I">(I)</num><content> A Federal agency.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf10c8234-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/4"><num value="4" class="bold">(4)</num><heading class="bold"> Special funding considerations</heading><chapeau style="-uslm-lc:I12" class="indent1">In entering into agreements under this subsection, the Secretary shall give priority to applications submitted by—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf10c8235-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/4/A"><num value="A">(A)</num><content> a State department of agriculture or an office of the chief animal health official of a State; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf10c8236-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/4/B"><num value="B">(B)</num><chapeau> an eligible entity that will carry out program activities in a State or region in which—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idf10c8237-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/4/B/i"><num value="i">(i)</num><content> an animal pest or disease is a Federal concern; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf10c8238-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/4/B/ii"><num value="ii">(ii)</num><chapeau> the Secretary determines a potential exists for the spread of an animal pest or disease after taking into consideration—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idf10c8239-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/4/B/ii/I"><num value="I">(I)</num><content> the agricultural industries in the State or region;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idf10c823a-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/4/B/ii/II"><num value="II">(II)</num><content> factors contributing to animal pest or disease in the State or region, such as the climate, natural resources, and geography of, and native and exotic wildlife species and other disease vectors in, the State or region; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idf10c823b-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/4/B/ii/III"><num value="III">(III)</num><content> the movement of animals in the State or region.</content>
</subclause>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf10c823c-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/5"><num value="5" class="bold">(5)</num><heading class="bold"> Consultation</heading><content><p style="-uslm-lc:I12" class="indent1">For purposes of setting priorities under this subsection, the Secretary shall consult with eligible entities specified in paragraph (3). The Federal Advisory Committee Act (5 U.S.C. App.) <ref class="footnoteRef" idref="fn002358">1</ref><note type="footnote" id="fn002358"><num>1</num> See References in Text note below.</note> shall not apply to consultation carried out under this paragraph.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf10c823d-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/6"><num value="6" class="bold">(6)</num><heading class="bold"> Application</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idf10c823e-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/6/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">An eligible entity specified in paragraph (3) seeking to enter into an agreement under the Program shall submit to the Secretary an application containing such information as the Secretary may require.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idf10c823f-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/6/B"><num value="B" class="bold">(B)</num><heading class="bold"> Notification</heading><chapeau style="-uslm-lc:I13" class="indent2">The Secretary shall notify each applicant of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idf10c8240-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/6/B/i"><num value="i">(i)</num><content> the requirements to be imposed on the eligible entity that is the recipient of funds under the Program for auditing of, and reporting on, the use of such funds; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf10c8241-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/6/B/ii"><num value="ii">(ii)</num><content> the criteria to be used to ensure activities supported using such funds are based on sound scientific data or thorough risk assessments.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idf10c8242-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/6/C"><num value="C" class="bold">(C)</num><heading class="bold"> Non-Federal contributions</heading><chapeau style="-uslm-lc:I13" class="indent2">When deciding whether to enter into an agreement under the Program with an eligible entity described in paragraph (3), the Secretary—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idf10c8243-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/6/C/i"><num value="i">(i)</num><content> may take into consideration an eligible entity’s ability to contribute non-Federal funds to carry out such an agreement; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf10c8244-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/6/C/ii"><num value="ii">(ii)</num><content> shall not require such an eligible entity to make such a contribution as a condition to enter into an agreement.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf10c8245-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/7"><num value="7" class="bold">(7)</num><heading class="bold"> Use of funds</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idf10c8246-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/7/A"><num value="A" class="bold">(A)</num><heading class="bold"> Use consistent with terms of cooperative agreement</heading><content><p style="-uslm-lc:I13" class="indent2">The recipient of funds under the Program shall use the funds for the purposes and in the manner provided in the agreement under which the funds are provided.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idf10c8247-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/7/B"><num value="B" class="bold">(B)</num><heading class="bold"> Sub-agreement</heading><content><p style="-uslm-lc:I13" class="indent2">Nothing in this section prevents an eligible entity from using funds received under the Program to enter into sub-agreements with another eligible entity or with a political subdivision of a State that has legal responsibilities relating to animal disease prevention, surveillance, or rapid response.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf10c8248-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/b/8"><num value="8" class="bold">(8)</num><heading class="bold"> Reporting requirement</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than 90 days after the date of completion of an activity conducted using funds provided under the Program, the recipient of such funds shall submit to the Secretary a report that describes the purposes and results of the activities.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idf10c8249-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/c"><num value="c" class="bold">(c)</num><heading class="bold"> National Animal Vaccine Bank</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf10c824a-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Establishment</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall establish a national animal vaccine and veterinary countermeasures bank (to be known as the National Animal Vaccine and Veterinary Countermeasures Bank and referred to in this subsection as the “Vaccine Bank”) to benefit the domestic interests of the United States.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf10c824b-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Elements of Vaccine Bank</heading><chapeau style="-uslm-lc:I12" class="indent1">Through the Vaccine Bank, the Secretary shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf10c824c-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/c/2/A"><num value="A">(A)</num><content> maintain sufficient quantities of veterinary countermeasures to appropriately and rapidly respond to the most damaging animal diseases affecting or with potential to affect human health or the economy of the United States; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf10c824d-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/c/2/B"><num value="B">(B)</num><content> leverage, when appropriate, the mechanisms and infrastructure that have been developed for the management, storage, and distribution of the National Veterinary Stockpile.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf10c824e-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Priority for response to foot and mouth disease</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall prioritize the acquisition and maintenance of sufficient quantities of foot and mouth disease vaccine and accompanying diagnostic products for the Vaccine Bank. As part of such prioritization, the Secretary may offer to enter into one or more contracts with one or more entities that are capable of producing foot and mouth disease vaccine and that have surge production capacity of the vaccine.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idf10ef14f-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/d"><num value="d" class="bold">(d)</num><heading class="bold"> Funding</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf10ef150-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Mandatory funding</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idf10ef151-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/d/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> Fiscal years 2019 through 2022</heading><content><p style="-uslm-lc:I13" class="indent2">Of the funds of the Commodity Credit Corporation, the Secretary shall make available to carry out this section $120,000,000 for the period of fiscal years 2019 through 2022, of which not less than $5,000,000 shall be made available for each of those fiscal years to carry out subsection (b).</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idf10ef152-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/d/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Subsequent fiscal years</heading><content><p style="-uslm-lc:I13" class="indent2">Of the funds of the Commodity Credit Corporation, the Secretary shall make available to carry out this section $30,000,000 for fiscal year 2023 and each fiscal year thereafter, of which not less than $18,000,000 shall be made available for each of those fiscal years to carry out subsection (b).</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idf10ef155-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/d/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> National Animal Disease Preparedness and Response Program; National Animal Vaccine and Veterinary Countermeasures Bank</heading><content><p style="-uslm-lc:I13" class="indent2">In addition to the funds made available under paragraph (1), there is authorized to be appropriated such sums as are necessary for each of fiscal years 2019 through 2023 to carry out subsections (b) and (c).</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idf10ef156-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/d/2/C"><num value="C" class="bold">(C)</num><heading class="bold"> Additionality</heading><content><p style="-uslm-lc:I13" class="indent2">The funds authorized for appropriation under this paragraph are in addition to any funds authorized or otherwise made available under this section or <ref href="/us/usc/t7/s8316">section 8316 of this title</ref>.</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idf10ef159-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/d/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Eligible entities</heading><content><p style="-uslm-lc:I13" class="indent2">Of the funds made available under this section or <ref href="/us/usc/t7/s8316">section 8316 of this title</ref> to carry out the National Animal Disease Preparedness and Response Program under subsection (b), not more than 10 percent may be retained by an eligible entity that receives funds under any agreement entered into under such subsection, including any sub-agreement under paragraph (7)(B) of such subsection to pay administrative costs incurred by the eligible entity to carry out activities under the Program.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf10ef15a-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/d/4"><num value="4" class="bold">(4)</num><heading class="bold"> Duration of availability</heading><content><p style="-uslm-lc:I12" class="indent1">Funds made available under this subsection, including any proceeds credited under paragraph (5), shall remain available until expended.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf10ef15b-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/d/5"><num value="5" class="bold">(5)</num><heading class="bold"> Proceeds from veterinary countermeasures sales</heading><chapeau style="-uslm-lc:I12" class="indent1">Any proceeds of a sale of veterinary countermeasures from the Vaccine Bank shall be—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf10ef15c-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/d/5/A"><num value="A">(A)</num><content> deposited into the Treasury of the United States; and</content>

<subparagraph style="-uslm-lc:I13" class="indent2" id="idf10ef15d-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/d/5/B"><num value="B">(B)</num><content> credited to the account for the operation of the Vaccine Bank to be made available for expenditure without further appropriation.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf10ef15e-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/d/6"><num value="6" class="bold">(6)</num><heading class="bold"> Limitations on use of funds for certain purposes</heading><content><p style="-uslm-lc:I12" class="indent1">Funds made available under the National Animal Health Laboratory Network, the National Animal Disease Preparedness and Response Program, and the Vaccine Bank shall not be used for the construction of a new building or facility or the acquisition or expansion of an existing building or facility, including site grading and improvement and architect fees.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idf10ef15f-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/e"><num value="e" class="bold">(e)</num><heading class="bold"> Availability and purpose of funding</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf10ef160-0974-11f0-9dfd-afe1829a8806" identifier="/us/usc/t7/s8308a/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Using the funds made available under subsection (d), the Secretary of Agriculture shall offer to enter into contracts, grants, cooperative agreements, or other legal instruments under subsections (a) through (c) during each of the fiscal years 2019 through 2023.</p>
