election payment</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “average crop revenue election payment” means a payment made to producers on a farm under section 8715 <ref class=\"footnoteRef\" idref=\"fn002334\">1</ref><note type=\"footnote\" id=\"fn002334\"><num>1</num> See References in Text note below.</note> of this title.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id53c31324-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Base acres</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id53c31325-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The term “base acres”, with respect to a covered commodity on a farm, means the number of acres established under <ref href=\"/us/usc/t7/s7911\">section 7911 of this title</ref> as in effect on <date date=\"2007-09-30\">September 30, 2007</date>, subject to any adjustment under <ref href=\"/us/usc/t7/s8711\">section 8711 of this title</ref>.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id53c31326-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Peanuts</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The term “base acres for peanuts” has the meaning given the term in <ref href=\"/us/usc/t7/s8751\">section 8751 of this title</ref>.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id53c31327-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Counter-cyclical payment</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “counter-cyclical payment” means a payment made to producers on a farm under section 8714 <sup>1</sup> of this title.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id53c31328-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Covered commodity</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “covered commodity” means wheat, corn, grain sorghum, barley, oats, upland cotton, long grain rice, medium grain rice, pulse crops, soybeans, and other oilseeds.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id53c31329-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Direct payment</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “direct payment” means a payment made to producers on a farm under section 8713 <sup>1</sup> of this title.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id53c3132a-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/6\"><num value=\"6\" class=\"bold\">(6)</num><heading class=\"bold\"> Effective price</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “effective price”, with respect to a covered commodity for a crop year, means the price calculated by the Secretary under section 8714 <sup>1</sup> of this title to determine whether counter-cyclical payments are required to be made for that crop year.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id53c3132b-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/7\"><num value=\"7\" class=\"bold\">(7)</num><heading class=\"bold\"> Extra long staple cotton</heading><chapeau>The term “extra long staple cotton” means cotton that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id53c3132c-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/7/A\"><num value=\"A\">(A)</num><content> is produced from pure strain varieties of the Barbadense species or any hybrid of the species, or other similar types of extra long staple cotton, designated by the Secretary, having characteristics needed for various end uses for which United States upland cotton is not suitable and grown in irrigated cotton-growing regions of the United States designated by the Secretary or other areas designated by the Secretary as suitable for the production of the varieties or types; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id53c3132d-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/7/B\"><num value=\"B\">(B)</num><content> is ginned on a roller-type gin or, if authorized by the Secretary, ginned on another type gin for experimental purposes.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id53c3132e-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/8\"><num value=\"8\" class=\"bold\">(8)</num><heading class=\"bold\"> Loan commodity</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “loan commodity” means wheat, corn, grain sorghum, barley, oats, upland cotton, extra long staple cotton, long grain rice, medium grain rice, soybeans, other oilseeds, graded wool, nongraded wool, mohair, honey, dry peas, lentils, small chickpeas, and large chickpeas.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id53c3132f-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/9\"><num value=\"9\" class=\"bold\">(9)</num><heading class=\"bold\"> Medium grain rice</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “medium grain rice” includes short grain rice.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id53c31330-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/10\"><num value=\"10\" class=\"bold\">(10)</num><heading class=\"bold\"> Other oilseed</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “other oilseed” means a crop of sunflower seed, rapeseed, canola, safflower, flaxseed, mustard seed, crambe, sesame seed, or any oilseed designated by the Secretary.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id53c31331-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/11\"><num value=\"11\" class=\"bold\">(11)</num><heading class=\"bold\"> Payment acres</heading><chapeau>The term “payment acres” means, in the case of direct payments and counter-cyclical payments—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id53c31332-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/11/A\"><num value=\"A\">(A)</num><content> except as provided in subparagraph (B), 85 percent of the base acres of a covered commodity on a farm on which direct payments or counter-cyclical payments are made; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id53c31333-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/11/B\"><num value=\"B\">(B)</num><content> in the case of direct payments for each of the 2009 through 2011 crop years, 83.3 percent of the base acres for the covered commodity on a farm on which direct payments are made.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id53c31334-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/12\"><num value=\"12\" class=\"bold\">(12)</num><heading class=\"bold\"> Payment yield</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “payment yield” means the yield established for direct payments and the yield established for counter-cyclical payments under <ref href=\"/us/usc/t7/s7912\">section 7912 of this title</ref> as in effect on <date date=\"2007-09-30\">September 30, 2007</date>, or under <ref href=\"/us/usc/t7/s8712\">section 8712 of this title</ref>, for a farm for a covered commodity.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id53c31335-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/13\"><num value=\"13\" class=\"bold\">(13)</num><heading class=\"bold\"> Producer</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id53c31336-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/13/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The term “producer” means an owner, operator, landlord, tenant, or sharecropper that shares in the risk of producing a crop and is entitled to share in the crop available for marketing from the farm, or would have shared had the crop been produced.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id53c31337-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/13/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Hybrid seed</heading><chapeau>In determining whether a grower of hybrid seed is a producer, the Secretary shall—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id53c31338-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/13/B/i\"><num value=\"i\">(i)</num><content> not take into consideration the existence of a hybrid seed contract; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id53c31339-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/13/B/ii\"><num value=\"ii\">(ii)</num><content> ensure that program requirements do not adversely affect the ability of the grower to receive a payment under this chapter.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id53c3133a-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/14\"><num value=\"14\" class=\"bold\">(14)</num><heading class=\"bold\"> Pulse crop</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “pulse crop” means dry peas, lentils, small chickpeas, and large chickpeas.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id53c3133b-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/15\"><num value=\"15\" class=\"bold\">(15)</num><heading class=\"bold\"> State</heading><chapeau>The term “State” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id53c3133c-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/15/A\"><num value=\"A\">(A)</num><content> a State;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id53c3133d-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/15/B\"><num value=\"B\">(B)</num><content> the District of Columbia;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id53c3133e-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/15/C\"><num value=\"C\">(C)</num><content> the Commonwealth of Puerto Rico; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id53c3133f-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/15/D\"><num value=\"D\">(D)</num><content> any other territory or possession of the United States.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id53c31340-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/16\"><num value=\"16\" class=\"bold\">(16)</num><heading class=\"bold\"> Target price</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “target price” means the price per bushel, pound, or hundredweight (or other appropriate unit) of a covered commodity used to determine the payment rate for counter-cyclical payments.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id53c31341-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/17\"><num value=\"17\" class=\"bold\">(17)</num><heading class=\"bold\"> United States</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “United States”, when used in a geographical sense, means all of the States.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id53c31342-bf32-11e3-b5d9-a54f02b4e3bf\" identifier=\"/us/usc/t7/s8702/18\"><num value=\"18\" class=\"bold\">(18)</num><heading class=\"bold\"> United States Premium Factor</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “United States Premium Factor” means the percentage by which the difference in the United States loan schedule premiums for Strict Middling (SM) 1⅛-inch upland cotton and for Middling (M) 1<sup>3</sup>⁄<sub>32</sub>-inch upland cotton exceeds the difference in the applicable premiums for comparable international qualities.</p>\n</content>\n</paragraph>\n<sourceCredit
